TERMS OF SALE

These Terms of Sale govern the sale of products by SleepHue, a brand operated by Lemoine Titouan Yannis Marcel ("we," "us," "our"), to customers ("you") through sleephue.com. They apply in addition to our Terms of Service.

1. Scope

These Terms of Sale apply to all orders placed on sleephue.com, whether you are located in the European Union, the United States, or elsewhere.

2. Product Information

We describe our product, the SleepHue anti-snoring device, as accurately as possible on the Site, including images, specifications, and directions for use. Product photos are for illustrative purposes; minor variations in packaging or appearance may occur. SleepHue is a wellness device using dual-pulse stimulation technology; it is not a medical device and is not intended to diagnose, treat, cure, or prevent sleep apnea or any other medical condition.

3. Price

Prices are displayed in the currency shown at checkout and are inclusive of any applicable taxes at the time of purchase, unless stated otherwise. For orders shipped outside the country of origin, additional customs duties, import taxes, or local fees may apply and are the customer's responsibility (see our Shipping Policy). We reserve the right to change prices at any time; the price applicable to your order is the one displayed at checkout when your order is confirmed.

4. Order Confirmation

Your order is confirmed once payment has been successfully processed. You will receive an order confirmation email summarizing your purchase. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or product unavailability, in which case you will be fully refunded.

5. Payment

Payment is due in full at the time of order. We accept the payment methods displayed at checkout, processed securely through our third-party payment providers. We do not store your full payment card details.

6. Delivery

Delivery terms, estimated timeframes, and shipping costs are detailed in our Shipping Policy. Risk of loss and title for products purchased pass to you upon delivery to the carrier, except where mandatory consumer protection law provides otherwise.

7. Retention of Title

We retain full ownership of the ordered products until full payment of the price has been received.

8. Right of Withdrawal and Returns

If you are an EU/EEA consumer, you benefit from a 14-day statutory right of withdrawal, as further described in our Return & Refund Policy. Regardless of your location, we also offer a voluntary 30-day money-back guarantee, as detailed in that same policy.

9. Legal Guarantees (EU/France)

If you are a consumer in France or the European Union, your purchase benefits from the following statutory guarantees, independent of and in addition to our voluntary 30-day guarantee:

  • Legal guarantee of conformity (garantie lĂ©gale de conformitĂ©), under Articles L217-3 and following of the French Consumer Code, allowing you to request repair or replacement of a product that does not conform to the contract, free of charge, within 2 years of delivery.
  • Legal guarantee against hidden defects (garantie des vices cachĂ©s), under Articles 1641 and following of the French Civil Code, allowing you to request a refund of the price or a price reduction if the product has a hidden defect that makes it unfit for its intended use.

These legal guarantees apply regardless of any commercial warranty and are not limited by our 30-day money-back guarantee.

10. Warranty (US and Other Non-EU Customers)

For customers outside the EU/EEA, products are covered by our 30-day money-back guarantee as described in our Return & Refund Policy. Nothing in these Terms limits any warranty rights you may have under the mandatory consumer protection laws of your U.S. state of residence.

11. Product Safety and Intended Use

The SleepHue device uses dual-pulse electrical stimulation and is intended for use as described on the label and product page. It is not intended for use by individuals with a cardiac pacemaker or other implanted electronic medical device, by pregnant women, or by children. If you have a diagnosed sleep disorder (including sleep apnea), consult your doctor before use — this device is not a substitute for medical evaluation or treatment. Discontinue use and consult a healthcare professional if you experience any adverse reaction.

12. Force Majeure

We shall not be held liable for any delay or failure to perform our obligations resulting from events beyond our reasonable control, including but not limited to natural disasters, carrier disruptions, customs delays, or governmental restrictions.

13. Consumer Mediation (France/EU)

In accordance with Article L616-1 of the French Consumer Code, if you are a consumer and a dispute has not been resolved through our customer support, you are entitled to refer the matter free of charge to a consumer mediator: [name and contact details of the consumer mediator to add]. EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

14. Governing Law

These Terms of Sale are governed by French law. This does not deprive you, if you are a consumer resident in the European Union, the United States, or elsewhere, of the protection afforded by any mandatory consumer protection provisions of your country or state of residence.
